Easy To Sign Up Just read and sign the simple one page "Agreement for Services" on the reverse side and submit a check in the amount of $120 payable to EasyBusinessFinder.com to the address below. Preferred Listing The earlier you sign up, the higher you are listed. You retain your preferred listing status by renewing. As the listing of categories and subcategories grows, you may move up into a new subcategory (with your approval). No Administration Fee There are no administrative or hidden fees with EasyBusinessFinder.com. If you need to change information on your listing, there is no charge for the first change per year. A small, appropriate fee will be charged for subsequent changes made within the year. Free listing until October 1, 2006 When you purchase, you will receive FREE ad space until your listing subscription starts on October 1, 2006. Your listing will appear for a one-year period starting October 1, 2006, and ending one year later on September 30, 2007. By Purchaser signing this Agreement for Services, and Provider cashing or otherwise endorsing for deposit payment instrument (check, money order. etc.) BOTH parties agree to be bound by the following terms and conditions: Provider shall advertise for Purchaser in the form of web-based advertising, for which Purchaser agrees to pay the sum of $120 per year in advance. Provider agrees to maintain the web-based advertising without any material amount of "down-time" except as needed for web page maintenance, or as a result of circumstances or Acts of God over which Provider has no control, such as flood, power-failure, earthquake, etc. Purchaser agrees to provide accurate information to Provider so that Provider can properly maintain account, and advertising information. Provider is under no obligation to verify the accuracy of any information provided by Purchaser. It is mutually understood that this web-based advertising will be used by families and/or businesses in the conduct of their daily business activities. Therefore, Provider will not knowingly allow any direct link (a web page that will be accessed by clicking on the "webpage" noted above), to any web-pages that Provider may, in its sole discretion, deem inappropriate, or that may contain sexually explicit or otherwise inappropriate material. If any such direct link is found to exist, Provider will, in its sole discretion, either request Purchaser to change the content of that direct link, or discontinue service and make a pro-rata refund to Purchaser at the rate of $10 per unused month. Limitation of Liability: With regard to the services to be preformed by Provider pursuant to the terms of this agreement, the Provider shall not be liable to the Purchaser, or to anyone who may claim any right due to his relationship with the Purchaser, for any acts or omissions in the performance of services on the part of the Provider or on the part of the agents, employees, or independent contractors of the Provider. The Purchaser shall hold the Provider free and harmless from any obligations, costs, judgments, attorneys' fees, attachments arising from or growing out of the services rendered by Provider pursuant to the terms of this agreement or in any way connected with the rendering of said services, including, but not limited to, any consequential damages or loss of business as a result of this agreement or extension being granted as a result of the services of Provider and the terms of this agreement. This agreement shall include any terms as included on the reverse of this agreement appearing as advertising or appearing as general information about the product. E-mail communication shall be deemed written communication by either party once a reply e-mail has been received by the originator from the other party. Purchaser agrees that Provider may include any of the information shown on this agreement, with the exception of the contact name and owner name as listed above, on the web-based advertising page. If Purchaser does not renew this agreement for the succeeding years, it will be dropped from advertising, and its space (preferred listing) will be lost. The Renewal agreement and annual fee is due and owing thirty (30) days prior to expiration of agreement. Renewals will be governed by the "Agreement for Services" in effect on the date of renewal. By signing this form, Purchaser agrees that this agreement is the exact same wording as was either provided in person or downloaded from www.EasyBusinessFinder.com, and no alterations to wording have been made. This agreement contains all of the terms and conditions of service. There may be no additions or other representations by anyone holding agency status or appearing to hold agency status. This is a binding contract. Any person signing this "Agreement for Services" in a representative or fiduciary capacity has the authority to legally bind Purchaser to the terms of this agreement. By signing this agreement, I agree that I have read and understand, and agree to be bound by all of the terms and conditions of this agreement. I further certify that the information contained above is accurate, and to the best of my knowledge the above business is in compliance with all governmental licensing requirements. I/We understand that this special multi-listing pricing is available as a promotional campaign, and may end at any time with or without advance notice. Once accepted by EasyBusinessFinder.com, and by cashing or otherwise endorsing for deposit payment instrument, (check, money order. etc.) this addendum becomes binding on both parties.
